So under the new 2257 laws, can I hire a "record keeper"?

    So under the new 2257 laws, can I hire a "record keeper"?

    And if so, why can that record keeper not be my sponsor? In other words, just link all 2257 pages from my sites to the corresponding site/sponsor's 2257 infos? The records are there and available for inspection.

    Also, if you run a thumb TGP and link to FHG's, but in the thumb prewview you only use face shots, will that be exempt? This is all hitting me like a ton of bricks

      1) No

      2) Not if the original image itself was sexually explicit. Cropping, blurring, etc., in no way exempts an image from compliance.

      Use non explicit thumbs of non explicit full size pics.

        Actually, if you take an explicit image and create a non-explicit image with it, that non-explicit image should be exempt, as non-explicit are not covered by 2257.

            Specifically on record-keeping, they want to deal with one company at a time. The investigative scope of 2257 investigations is not extended to parent or child companies, etc, so basically what they want is a record-keeper who works at the place of business of the business that has done the publishing in question. Third-party record keeping was specifically rejected.

            There is also a somewhat vague requirement to 'keep records separate', which, to my mind, translates to 'whatever you do you'd better know which model goes with which pics and where they have been used', but which could translate into a requirement to keep separate records for each company you own..... legal opinion needed from your lawyer on that one.

                If you are using hardcore images then YOU have to have the records and YOU are the "record keeper" according to 2257. And so when someone clicks you 2257 link on your site YOUR name adn YOUR address have to appear so the DOJ knows who to contact if they wish to do an inspection

                As long as the orignal was a non-hardcore face shot.

                          Unfortunately you'd have to have the 2257 info for your 'would you hit it' pic if it's explicit, as you are 'publishing' it by linking it here and hence become a secondary publisher.

                          Or possibly Lensman does, but that would depend on whether or not he's deemed to have 'control' over the content of this board.
