    ATTN: TGP Owners - Can I Get A Little Help?

    If you haven't seen THIS THREAD here's the deal. This guy submitted A GALLERY PROMOTING MENSNICHE using CONTENT STOLEN FROM NAUGHTY ALLIE.

    As early as Saturday morning I began contacting the sponsor, the affiliate/webmaster and filing DMCA notices with the hosting company (WebAir) and the registrar (GoDaddy). As you can see it's been 3 days and the content is still up and the links to the sponsors still work.

    During an ICQ conversation with the "webmaster" who stole the content he stated to me: "I've told you allready, that I haven't stolen anythink..." Since the guy is in either Germany or Afganistan (depending on which contact info you believe) he seems to think he's untouchable.

    All I'm asking is that you send a message to this guy and others like him and ban him from submitting galleries to your TGP. You can also CHECK HERE to see if this particular gallery has been submitted to your TGP. If he doesn't have a problem with using stolen content for his galleries I'm quite sure he doesn't have a problem with CHEATING TGPS EITHER!

    Allie and I would both greatly appreciate your cooperation in this matter.

              Yes, as I have stated I've already sent a DMCA notice to the host (WebAir) and as you can see his hosting is still working just fine.

                              I certainly wouldn't have thought so however they have been notifed of this issue.                                       how can they terminate the link, to where when its clicked, it doesnt go to them? sure they can delete the guys acct, is it possible to make the link invalid? If there is, then I concur and they need to stop it all together.

                                                      I'm talking about the link in the gallery itself! They can easily redirect/terminate that link so that neither they nor their affiliate profit from the use of our content. I gaurantee you that if they were to freeze the link that the affiliate would have instantly removed the content.

                                                      Ask yourself this? The affiliate in question has known about the this issue for three days and knows that I've been in contact with MensNiche. If that affiliate was the least bit concerned that his account with MensNiche was in jeopardy don't you think he would have immediately removed the content?

                                                      Based on the way he was taunting me on ICQ today, this guy KNOWS that nothing is going to happen to his account with MensNiche!

And that's the flaw with the DMCA when applied to TGP galleries. Here's how it works: The content thief submits his galleries to his TGP submission list, maybe the content owner gets lucky and one of the TGP owners recognizes the content as being stolen and reports that to the content owner (at this point at least a day or 2 has passed). Now the content owner makes attempts to contact the thief and request removal of the content. When the thief doesn't comply (more time has passed) the content owner files a DMCA notice with the host, sponsor, registrar, etc. Now they have time to respond to it (assuming the respond at all). By the time all these things have taken place the galleries have fallen off of the "higher traffic" pages and have been archived and are getting very little traffic so the thief then happily complies with the removal request from the host, sponsor, registrar, etc because they are no longer profiting from the gallery.

                                                                                                                  There are no negative consequences for the thief, that?s the problem! Assuming they are even caught in the act, the worst case scenario is that they are made to remove the content after it has stopped generating revenue for them.

                                                                                                                          If your images are copyrighted you can seek damages in court.
