    Following on from the 'sent down for selling porn' - which should obviously have read - sent down for selling obscene material 'thread'.... what is obscene...? where does this line get drawn?

      Good luck figuring that one out. Maybe you'll write the book on understanding women too.         OK.. Assuming you are talking of the UK - Here's the guidelines :-

        Charging practice

        Specimen indictment (Indictment Precedent Manual).

        The particulars should clearly identify the obscene article e.g. "an Internet website entitled "Welcome" (exhibit reference KDW/6)."

        It is impossible to define all types of activity which are suitable for prosecution; however, the following categories are those most commonly used:

        * sexual acts with children
        * sexual assaults upon children
        * portrayal of incest
        * buggery with an animal
        * rape
        * drug taking
        * flagellation
        * torture with instruments
        * bondage (especially where gags are used)
        * dismemberment or graphic mutilation
        * cannibalism
        * activities involving perversion or degradation (such as drinking urine or smearing excreta on a person's body)
        Note the last item which covers "scat" and which was the reason for the prosecution of "the trader". It has little to do with video ratings or the BBFC - it was basically an Obscene Publications Act offense.

            That said the BBFC guidlines are probably the best guide and easy to find with a quick search. The CPS is currently very unlikely to go ahead with prosecution of anything that follows BBFC guidlelines for R18's. Scat, pissing on anther person, beastiality, fisting, rape etc etc all fall well outside of those guidlines. Although still a little vague they are still better defined than anything else and as above the CPS is unlikely to go after anything that follows them.

              With clear laws where would all the fun be? If you actually knew what was legal and what wasn't, who would pay all the lawyers. There would be less juristication needed, less buerocracy etc. So the lawyers, judges and buerocrats make up more laws which are more complex and more vague and more contradictory up to the point that you can't even file your taxes without a college degree. It's a self-perpetuating and growing pile of mostly value-free self-serving garbage.

                Sure.. can see it is prob better to follow the BBFC guidelines - keeps it one step further down the tree from the OPA.

                To be honest got to admit I never kept up with the ratings system - tho remember submitting a few videos to them years ago for approval. If you see this post and know of the a relevant net URL - can you post it please? Much appreciated!

                      Melon Farmers is a great site for stuff like that and always interesting to see what the censor has been removing from films.

                      http://www.melonfarmers.co.uk/guide05.htm is the actual guidelines page but as I say the details of cuts from recent films tends to make better reading :D

                              While discussing the subject,something that I've found interesting for a while now...

                              If you watch late night TV in the UK, the adult sex documentary programs (Eurotrash type stuff for those that are he UK and know what Eurotrash is) you often see short BDSM scenes of people whipped and spanked to the extent that whelts and marks are left. There was even a presenter getting his ballbag nailed to some wood by a prostitute/madam.

                              You can show that on TV now but not in an R18. Strange double-standards we have.

                              Oh - and you'll probably also notice on Melon Farmers that the reason for most R18 restrictions is simple advice from the CSS etc on OPA stuff hence my earlier comments. To a large extent BBFC rules simply mirror current thinking as regards OPA.

                                  when it comes down to law I have accepted the fact that something as simple as a cock in cunt can be classified as obscene

                                  in my mind though, it takes much more to cross the link of obscene, I guess as an example I would say ass to mouth is obscene to me, horse fucking obscene but not on the same level as obscene as ass to mouth....eating shit pretty much tops it all, and in mind is the most obscene

                                        Overall.. was just looking via melonfamers and thinking - the UK, despite the obvious apparent idiocy in areas, - this is a far healthier environment for the adult biz than is currently the case in the US.

                                        Where you got the Crown Prosecution Service willingly publish guidelines as to the general common categories of "obscenity" and where there is to a degree, a barrier as protection in the form of BBFC.

                                        It also appears that there is an acceptance of "porn on the net" and presumably that is going nowhere in the near future since it involves other countries and overlap - plus there is an element of "forced acceptance" via the EU where, if need be, - there is a open avenue to EU Courts of Appeal if all else fails.

                                        Don't sound so bad - tho that's the simplified version

                                          Yup - I tend to agree. Online porn has been a 'grey area' for a long while and it's no bad thing. As long as you don't push beast or scat etc you get left alone and as you say, if they ever did go for a conviction of vanilla hardcore the EU appeals court kicks in too if taken that far.

                                          I saw a post a few years back on a different board where someone said he wished they would remove the grey area and clarify it. Fuck that! Were that to happen there is a strong possibility the webmasters in the UK would lose out heavily.

                                          As with many laws in EU countries (cannabis in Holland for example) a grey area is fairly good - just don't step outside of it
