I need a civil lawyer... (my laptop story continued...)

So alot of you guys know what happened to my laptop

but I didn't give you guys the last update. but before I start, let me quickly recap

my laptop had a damaged jack (the one you plug into the wall to recharge the laptop) and I brought it to an electronics store run by my acquaintance's father.

months pass, until they tell me that they fixed the jack but they damaged the mouse cable on the laptop and have to order a new one

week after week, I get the same excuse: we ordered the wrong cable, this that, the guy who recieves the orders is on vacation, etc etc

after about 6 months, I decide to send them a letter which states that:

    a) either they fix the laptop within 2 weeks
    b) either they refund me the full value of the laptop (1700$US)

10 business days pass, which means that they didn't bother writing back.

another week after that, I call them, and to my surprise the guy tells me that they burnt the chip on the motherboard that makes the monitor work. So the motherboard is completely damaged and my laptop has no working screen.

I asked for a full refund, or a new laptop, but the guy refused. he told me the best he could do is give me back my laptop with a monitor on the side..

now forgive me if I'm wrong, but isin't the purposs of a laptop for it to be PORTABLE???

anyways, long story short, I have 2 options:
either i take them to a small claims court (Judge Judy type), or I get a lawyer to take care of this matter for me

which should I do? how much does a lawyer for this kind of situation cost? what are my chances of winning?

    thanx!

Just go thru small claims, no need for a lawyer.

Yeah that's a sure fire win in small claims court. Plus you can sue for up to 5,000 . I'd sue for the MAX.

            they didn't charge me anything...
it was actually supposed to be fixed for me for free... which makes the situation a little more complicated

I would make them pay for it in full.

Hire a lawyer to write them a letter stating what you want done. If not you will take them to court as well as charge them all court fee's + the money for a new laptop.

They would be stupid to let that goto court

As stated above you can also handle it yourself in small claims. Ive represented myself in 3-4 different cases and never had any problems(although I did sometimes seek legal advice from lawyers).

Get a lawyer to send a letter to them first. Then if they do nothing take it to small claims court.. Some jackasses just ignore everything until they hear from a lawyer, then they get scared and pay up.

what'd i'd do is goto court, get the forms needed, fill them out. walk right in the store, be as loud as fucking possible if theres customers there(if not, whats the point), wave the papers in front of their face and present them with 2 options "give me a working laptop, equivelent to mine or better, now, if i make it to the door before it's in my fucking hands my next stop is to drop these papers off at the courthouse" dont take any excuse period, if you dont walk out with a new laptop, file the papers, sounds like you cant possibly lose, just cause they were fixing it for free does not mean they dont have to cover damages.

stop being so patient and such a pussy.

Small claims is the way to go. You can sue for the purchase price and will get it as long as you bring all of your documentation and letters you sent. I would first follow up with a certified letter that is noterized to further document the whole ordeal.

As far as lost wages or missed work, that is almost always a no go.
