Judge Mark Martin said there wasn't enough evidence to convict 46-year-old Talaag Elbayomy of the summary offense. It was basically one man's word against another's, the judge said.
Martin received testimony from Elbayomy, Perce and Mechanicsburg Police Sgt. Brian Curtis who received the complaint from Perce. Curtis did not witness the alleged attack, Martin said.

The Judge neglected to address the fact that the ignorance of the law does not justify an assault and that it was the responsibility of the defendant to familiarize himself with our laws.
The cop said the dude admitted assaulting the atheist dude. The police officer said he brought evidence which proved beyond reasonable doubt.
