Sorry, I sympathise with your situation. It is unfortunate that you can not figure out a way to stop this group of webmasters from cheating you and breaking your TOS. But, they are only your TOS, they are not breaking the law, by violating your rules. You have the right to kick them out of your club house, and the right not to let them play with your ball.
You have to eat it like everyone else does. The second you engage in a DOS attack, you lose my sympathy.
First the attack is illegal, second even if you are able to skirt the issue of legality due to the juridictions, the attack has many externalities that you simply can not control, no matter what your overall intentions are. DrawnSex, was evidently already prepared for your attacks, but luckily did not send the traffic to any location that couldn't handle the situation. However, what if he had sent it somewhere else, where it would have cost that company money, time, etc?
No matter how large you are, you are under the same set of laws that govern everyone else. That helps protect people from your vigilante justice.
