No, no one can FORCE you to get an EIN, however many major corporations, wholesalers, OEM/ODM, etc., will refuse to do business with you if you don't have one and are using your SSN. Also, in many instances, by using your EIN on purchase orders (for resale) it is considered B2B and the B2B tax liabilty transfers to you (meaning you don't pay taxes and the other company does not charge you sales tax on most things). This is very true, there are also many companies that don't ask for it. Most of the companies that I have run across that ask for it are Tier 1 (and some Tier 2) distributors and wholesalers, as well as quite a few of the bigger Fortune 500s when you start discussing exclusive rights and such.
