I'm sure your trying all avenues but I bet you have a chance.
No matter what they tell you, there is someone at the bank high enough to make a decision that helps you out.
Be real nice and get to that person. Dont take no for an answer, but be nice most importantly.
Remind that person that you are not just an account number. Have prepared and show them statments, deposit slips, car payments that came from that bank acount. Basically everything that he could copy and prove to his board that you are and have what you say. He will want to cover his ass also.
Make sure he realizes that your car note is with his bank and those missing funds is what is used to pay that loan.
Ask him/her for suggestions for 3rd party organizations that can help out "victims".
Maybe they will realize that bad publicity and future defaulted loans might not be in their best interest.
The key to this is that you have to be nice throughout and you have to find the person that can make that decision.

Indeed, check-cashing scams were listed on an AP (or was it CNN?) article this week about the "top 5 internet scams".
For those not in the know, "419 scams" are a nickname from section 419 of Nigeria's criminal law or something, as Nigerians have been famous for decades for scamming people with various mail, phone, and now internet cons. Nigerians even scammed companies like Enron and other American scammers out of many millions, they're good at what they do! This con may or may not have involved Nigerians, but the "419" name is used more generically these days.
Details like payment methods could vary, but the basics of it work like this: someone sends you a certified check, say for $11,000, you deposit it, and they instruct you to wire $10,000 to another party, and keep $1,000 for your "work." They can give all sorts of reasons for why that might seem plausible. The victim, having been told by all their friends that they're a fucking idiot about to fall for a 419 scam, is cautious, and calls their bank to confirm that the certified check has cleared, and the funds are really available, and the bank assures them it has. They wire the $10,000, spend the $1,000 on booze and laugh at their stupid paranoid friends. Then a couple days later the bank receives the check back from the originating bank with insufficient funds...they were saying that it cleared *their* bank, not the originating bank. So they deduct the $11,000 you desposited to your account, and the $10,000 you wired out is still wired out, so you're $10G in the hole. Or if it's your son-in-law's account, your son-in-law is $10G in the hole. And some Nigerian village somewhere is having a big pig roast with champagne as they chuckle at the greed and stupidity of Americans.Comment

I'm not sure I'm 100% familiar with this scam. Was there a local "middleman" involved in the scam?
Did she deal directly with someone from nigeria or whereever?
We had something like that recently around here where a local guy was encouraging the people to "invest".
He was eventually sentenced to prison for 8 years. The important thing is that it was in federal courts. Federal courts will often include restitution in their sentence. The enforcemnt process is usually serious about the restitution.

jupz - I used to work for the bank. Unfortunately you will never see your cash again. When an account is jointly held, you are fooked good. NEVER co-sign for anyone and never go joint on an account with money in it you can't afford to lose.
However, the car should be fine, as long as you don't go deliquent on the loan... The car loan is based on income normally, so as long as everyone's income (your co-signers and yours) has stayed the same, the loan shouldn't be affected.
Perhaps, if you've held the car loan in good standing long enough, the bank may let you transfer it to your name now.Comment

That's how I understand it generally too, but perhaps the bank set up some a weird structure that combines a checking account with a loan account, the way you can have a credit card tied your checking account. Otherwise I don't see how they can directly tie an overdraft/debt in a savings/checking account to an independent auto loan.
