You are correct that Microsoft or anybody for that matter can sue you for any reason, spam or otherwise. You do not really need a reason to sue somebody. If you are Canadian and sued in the US and get a judgement against you, the US plaintiff can petition to a Canadian court to have the judgement enforced in Canada, this is quite common.
