Agreement Reached: PlayboyCash webmasters are not liable to Acacia for patents.

Playboy Enterprises has reached an agreement with Acacia to exempt it from any patent claims in the future. Additionally, Playboy is requiring Acacia to exempt all of its affiliates from patent claims, as long as it directly related to the promotion of Playboy products. The affiliate provision was a major sticking point for Playboy, and considerably delayed the agreement.

Webmaster programs that have previously reached an agreement with Acacia include TopBucks, TrafficCashGold, PlatinumBucks, CECash, FlyntDigital, and more.

I don't agree with it... but at this point it does not bother me as much.... Its like stuffing money in the carcass of a dead horse and saying you made an agreement that the horse will not attack us.

Adult.com has not settled with Acacia, and has filed a countersuit against the company. When Acacia agrees to drop their lawsuit, Adult.com will make sure its webmasters are covered as well.

I understand it, but kind of a spin.

Its too bad how that whole Acacia thing played out. It will eventually get defeated, but has turned into a pain in the butt.

Well then I retract my previous comment.... But how can you have reached an agreement with a company when you still still have pending lawsuits?

Or have they agreed to certain terms if you drop your countersuit?

                            Amen

Most webmasters run multiple affiliate links on their sites. So the sponsors that licensed with Acacia, would make the affiliate's percentage of revenue "exempt" from their 'contributory infringement' approach to webmasters.

Acacia is using the tactic (as well as those that have settled with them), that using ONLY sponsors that licensed the patent "protects" you from Acacia.

At this point, Acacia has not filed anymore lawsuits in the adult biz, and has their hands full with 11+ defendants.

The current defendants filed countersuits against Acacia too.

Maybe Acacia will drop their lawsuit against them as well.

I do believe Playboy Cash isn't totally owned by Lensman but a partnership with Playboy so it would seem that Playboy Cash being under the settlement of Playboy is not his decision as Adult.com has not settled. But that's just my guess.

Wait until the financials are released, Playboy (like Hustler) probably pays them next to nothing, but Acacia gets to use the brand name.

This seems to have been the strategy from the start. Try to get money from the little guys while giving it away to the big guys so they can keep the press releases coming and keep the stock price from tanking.

You can make a graph showing the Acacia stock price and the bullshit press releases. None of it has to do with income or the validity of the patent, it's all to do with how they manipulate gullible stock buyers.

I also would not be surprised to see Acacia send out another round of notices to small webmasters using the Playboy logo to try to convince people to settle, like they did with Hustler.

If it turns out that the Playboy deal really is as ridiculous as some have suggested it is, it proves that Acacia's plan is to fight the little guys, but settle with sweetheart deals for the big guys. What does that tell you about how strong Acacia really thinks their patent is if they aren't willing to fight big companies?

Without any legal letter sent to an affiliate webmaster about not being liable for broadcasting video or whatever the patent states...the webmaster is not legally covered.

I personally feel that anybody promoting sponsors who agreed with Acraaciia should get a written agreement that they will not get sued or sold out.

Acacia could not come after an affiliate to license their patent based on revenue derived from Playboycash. This would a "double dipping" situation that they can't do.

But, since most affiliate webmasters use more than one program, they could target you for the revenue you gained by using unlicensed programs and you would have to be able to separate out the revenue streams.

I think that Acacia has seen how futile it is to target the affiliate webmaster, and instead, now focus on the sponsors (which should have been the target anyways).

What does that tell you about how strong Acacia really thinks their patent is if they aren't willing to fight big companies?

                                                                                            very astute analysis.
