I have an opportunity to buy another photographers images at a very good price too good to pass up. All shot pre-2009 I believe.
These range from softcore to dildo masturbation and some Girl-Girl content also. I'm taking the time to examine all 2257 records for each photoset before I buy them.
The problems I have run into is that for some sets there is only pictures of I.D.s and a model release and not the other requirements info about aliases and stage names. On some the I.D. pictures where shot too far away, and on some the photographer section of the form was not filled out.
But as I understand it some pre-2009 content is exempt from 2257 " March 18, 2009 for works covered under this scheme only because they contain depictions of simulations or lascivious depictions of the genitals or pubic area. Such mere genital or pubic depictions were not subject to Section 2257 regulation before that date." - http://xxxlaw.com/articles/primer5.html
So my questions are
1: Am I safe using sets or parts of sets that DO NOT contain, penetration of toys, or oral sex, or actual masturbation. But only explicit nudes shot before 2009
2: Am safe using images that DO NOT contain, penetration of toys, or oral sex, or actual masturbation even though there might be images from that set that do contain those things yet those images will not be used.
3: Those will be labeled with an exception statement instead of a 2257 Records statement correct?
I know how to handle the normal 2257 non-exempt content from today forward and have record keeping set up for that by a 3rd part service.
