First thing I thought of when I read the name, was the video store started a referal program. I think this would be a very very easy case for them to win.

It is but, words in a dictionary can also be trademarked. Just like AOL tries to go after any domains with AOL in the name on trademark infringement.. Even if it's not the same words, big companies like this take this stuff very serious, no matter if it's right or wrong.
