From: Neil McIver [email protected] Date: July 12, 2001 Latest: Bob Schulz Hunger Strike: Interview on Fox News tonight at 9 PM Eastern Time Confessions of the California Franchise Tax Board -- Bob Schulz, founder of "We The People Foundation for Constitutional Education" has commenced his hunger strike this past July 1. As of this writing he continues the strike 12 days into the fast. His demands are rather simple: IRS Commissioner Charles Rossotti must deliver to him a list of government experts who will meet in a public forum on September 18, 2001, at the National Press Club in Washington DC for the purpose of defending the federal government against the conclusions of researchers of the so-called "tax honesty movement". They have so far refused to do so. Joining Schulz in his hunger strike is Roland Croteau. Both men are carrying out hunger strikes in Washington D.C. WTP's web site, http://www.givemeliberty.org, delivers the latest updates on the strike. Bob is apparently regularly participating in radio interviews, and is expected to be interviewed on Fox News "Hannity and Colmes" on July 12, 2001 (today) at 9 PM Eastern time. Apart from Fox News and numerous radio interviews, his hunger strike has not yet made it into the mainstream media. The last update I sent out on June 17, 2001 reported an expected IRS press release to take place on June 25, 2001, based on information forwarded by New York Times reporter, David Johnson (apparently assigned by the NY Times to cover the tax honesty movement). The anticipated release was expected to be a broad public announcement of new actions against numerous firms that have openly stated that they no longer withhold taxes from the pay to their employees. But there was no apparent news release at the appointed time. The only IRS news I was able to find about that time was a "friendly" report that the IRS may owe money to people - just like you - due to past unclaimed tax refunds. While it is possible the initial report of a press release may have been false from the start, it's also possible that the IRS shelved the planned hard line release so as not to tempt the media to further report Schulz's imminent hunger strike. They may have chose instead to present themselves as some kind of a friendly neighborhood government agency that likes to give people money as a PR stance in advance of any possible negative public sentiment generated against them by Bob Schulz. Bob is scheduled to be interviewed tonight, Thursday July 12, 2001 on Fox News "Hannity and Colmes" at 9 PM Eastern time. Any and all actions anyone can take to help bring public light to Bob's hunger strike, including letters and email to media and elected politicians can help put more pressure on the IRS. If the matter is left only to the discretion of IRS commissioner Charles Rossotti, then the IRS will be more than happy to let Bob die. While no one within the tax honesty movement that is actually encouraging Bob and Roland to starve to death (of course), there are, quite understandably, a number of people that have discouraged it. But Bob and Roland have independently chosen their own course and apparently remain quite firm in their resolve. Should they later decide to break off the strike without an IRS capitulation, they'll get a hero's welcome home. But as long as they are resolved to continue, a public show of support is what they need from everyone regardless of one's personal opinion on their endeavor. Confessions of the California Franchise Tax Board As reported by http://www.taxdefensefund.com/cgi-bi...s.cgi,hearings have continued on the case of the California Franchise Tax Board's May 2, 2001 raid on the home and business of Mr. Jesson, who has publicly declared he no longer withholds taxes from persons within the employ of his business, NTD Electronics. The above site reports the following dialog taking place during a June 20, 2001 hearing, where Agent Wilson of the FTB is testifying under questioning by Jesson's attorney, Derek Tabone. Presiding over the hearing is the same judge that signed the search warrant used by the FTB. At issue is the seizure of items not listed in the warrant. Tabone: Mr.Wilson what date is the withholding order? Wilson: April 30, 2001. Tabone: Mr. Wilson, did you show this to the judge on May 1,2001 when you ask him to sign the search warrant? Wilson: No I did not. Tabone: Mr.Wilson, was the withholding [order] sent to Mr. Jesson's business? Wilson: I don't know. Tabone: Mr. Wilson, did Mr. Jesson ever receive the withholding order? Wilson: I don't know. Tabone: Mr. Wilson, how was the withholding order sent to Mr. Jesson's business? Wilson: I don't know. Tabone: So Mr.Wilson, what your telling the court is that you had a withholding order dated April 30,2001, which wasn't given to the judge, plus you're not even sure if or when Mr.Jesson received this order. Which means that if this had been mailed there is no way Mr. Jesson could have even received [it] until the day of the raid. Therefore what violation could there be to allow you to just take things outside of the search warrant? Wilson: Well, we do it all the time to see what frame of mind the person is in. In Jesson's words: "[The] judge turned slowly and looked agent Wilson dead in the eyes and stated, you used MY WARRANT FOR THIS?!!!!!!!!!" Arrangements were then made to return about 50% of what was seized by the CFTB on May 2, 2001. Hearings are continuing, the next scheduled to take place Friday, July 13, 2001. Dispite the progress, much still remains to be done and Jesson is seeking donations to aid his defense.
