Never give a designer a 50 percent down payment unless you know they are trusted and have a great reputation.

I've done it twice, got shit designs back.. and said fuck it, never again.

sounds like a lack of communication on both parts, I only give 7 days terms to new clients with half upfront, but 30 days on repeat business.

He paid out 1/2 upfront, and the deadline was missed. If someone said I'm waiting for a paypal it'll clear in a few days.
he could have cut the guy some slack nope?

You pay for the completed website and generally are allowed up to 3 minor changes.

As far as payment - well - that's between you two. If he received the deposit then best way to do it is the same method. Designers get ripped off all the time and screwed around by people - so it's easy to get your guard up when someone doesn't comply on time. Same is true for company's who give a deposit and time line then don't get anything.

That is why everything must be written down and understood. Designer's need referrals to survive.

I am also cautious because right now we're only hearing half the story. Just get the work done - get the site and pay the final amount once everything is completed and find another designer after checking references.

I am sure designers don't want to hear this, but if they want to take their sweet time and ignore deadlines (that they set themselves) over and over again, I am simply not going to move heaven and earth to make immediate payments. If they want to create a huge pipeline of work by making false promises that they can't deliver on-time, then a little dilly-dallying on payment seems like a fair trade.

And I don't think its correct that you can't get a refund on digital gods with Paypal. I've opened disputes in the past on things like this and the provider always gave me their full attention at that point and came through a hurry so there must have been some risk of a settlement in my favor.

Bare in mind the OP did not paste the entire icq/email history and there was no deadline, that was added by OP after he ordered and agreed on price. If you order a design and don't specify a deadline and get a good deal partly cause you were not in a hurry how can you expect to come with a deadline halfway into the job and then refuse to pay when the job is done...

Saying you'll pay in a couple days is pretty far from refusing to pay. And if a designer quotes a completion time as two weeks, I consider that to be the deadline, set by the designer.

If the designer misses it by two weeks or a month and then has the nerve to demand payment in 24 hours "or else" I might be inclined to go ahead and fuck with them a little, even though it would clearly be contrary to both our business interests.

Basically, it would piss me off and cause me to behave irrationally.

From what I read it was moeloubani who came with the deadline after the work was underway: "when I asked for the design to be done I told him I wasn't in a rush ".

He then blackmails the designer:
"Then I email him and tell him that if I don't get an answer or see something by May 5th I'll be forced to ask for a refund of my deposit (50%)."

About the or else thing from the designer I'd like to see the entire email/message...

I have hired many designers, 50% down is normal, Sometimes nothing down. But never sent full payment until I had all complete files in my possession.

Come on, you know as well as anyone that every third world college offers ESL courses. College educated English does not mean Native English.

Shouldn't take on work if you are too busy to complete it. I have always paid my bills on time. Often sooner than I was supposed to just because I hate owing money to people.

But I ALWAYS get my designs delivered later than the agreed upon time frame. Designers are the last people I would want to pay up front to because once they have your money there's no rush and they are free to work on projects for people who weren't stupid enough to pay upfront.

The part that said ""college educated English." That means someone studied English or is an English major. Doesn't mean it's their first language.

Blackmail him? He ignored message after message for a week. What should I have done? Just let him keep ignoring my messages and write off the money as a loss? Wait a year until I ask him about it?

Not in a rush doesn't mean I don't need it, it means I'm not in a rush but I eventually need it.

If you're going to quote shit then at least do it right.

In and around two weeks is how long I would expect it to take because that is what he told the OP. THAT is the deadline. Whether the OP told the designer he was or wasn't in a rush is a moot point as the designer said TWO WEEKS.

In my operation I offer my clients a Statement of work. This details the entire scope of the deal's points that both parties sign off BEFORE work starts .. This way we know the expectations of BOTH sides.

I have progress payments in my statements of work as well that we have documents to accept the milestones mutually that are signed off on and payment remitted.

Payment:
1. New clients: 50% down to start, 25% progress payment at halfway mark and 25% at completion.

2. Existing clients: 1/3 to start, 1/3 as progress at halfway mark and last 1/3 at completion.

This has worked well for 10 years now to ensure that only a minimal risk is out there.

Documentation that is signed, project plans, agreed touchbase meeting times/dates, phone conversations, emails, IMs, etc work wonders.

#1 most important rule in business: NEVER ASSUME.
