Jay, speak to an attorney and see what you have to do to get a case against them. Talk to one of the attorneys that is involved with the anti piracy stuff that Airek is working on. If you need to DMCA them and give them "x" amount of time to take it down and then you can sue them, or if you can just sue them right now, whatever.

Well actually you would be sueing the " user " who uploaded the videos I would think even if the site took the video down. DMCA only protect the site if they take down the content, if they follow the DMCA rules then sue the " user" who put the content up. If you really think it is them they will be fucked. They will have to turn over all server logs of everyone who has uploaded your content. Get with a couple other sites and share the cost, i dont think it would be that much. Probably less then you paying someone full time to police your content. If they ignore your suit get a default judgement against them. I bet they still own something in the US that you can put a lean on or sieze. I don't know the exact law behind this but I am sure you have an angle you can use here. Get with an attorney and make an example of them.

NOTE: If you're going to DMCA them, make sure you record the USERNAMES of the offending "users".

If you can find an algorithm in their name creation process (assuming they're making users themselves) then you have a major legal case.

If you find they are not deleting users accounts after multiple deletions on different occasions, you have good ammo for your case.

If you note that the same videos re-appear after a certain time period, again you have good legal ammo.

Will this be a secret bat cave event? still excluded to the content producers and program owners?

If you are going to DMCA them, involve a lawyer to make sure it is done 100% by the book.

A Federal Court threw out Perfect 10s lawsuit vs. CCBill based upon the fact the the DMCA take down request did not comply with the instructions given on their notice.

If you get it wrong, it could compromise any case you may want to file.
