Genarlow Wilson sits in prison despite being a good son, a good athlete and high school student with a 3.2 GPA. He never had any criminal trouble. On the day he was to sit for the SAT, at seventeen years old, his life changed forever. He was arrested. In Douglas County he was accused of inappropriate sexual acts at a News Year?s Eve party. A jury acquitted him of the allegation of Rape but convicted him of Aggravated Child Molestation for a voluntary act of oral sex with another teenager. He was 17, and she was 15.

Along with the label ?child molester? which will require him throughout his life to be on a sexual offender registry, Genarlow received a sentence of eleven years ? a mandatory 10 years in prison and 1 year on probation.

On July 1st, the new Romeo and Juliet law went into effect in Georgia for any other teen that engages in consensual sexual acts. That change in the law means that no teen prosecuted for consensual oral sex could receive more than a 12 months sentence or be required to register as a sex offender.

Had this law been in effect when Genarlow Wilson was arrested, or had been done after the Marcus Dixon case, Genarlow would not now be in jail.

Genarlow and his mother are overjoyed that no one else in Georgia will have to know their pain. In the meantime, however, the legal fight goes on for Genarlow Wilson.

Genarlow has been incarcerated since February 25, 2005.

The girl in question went on the stand and told everyone that she initiated everything, it was her idea and he just went along with it, but that didn't matter.

Will he be released? Not any time soon. He's running out of options on the state level and will have to work on getting his case turned into a federal civil rights case for further options.

Interesting case , I would never thought you could be charged for such a long term being a minor...

Um, they were 2 years age difference. Aggravated Child Molestation? What child? They are both "TEENAGERS." Thats what teenagers do, experiment with sex. That is crazy and I would fight that sentence. 10 years? There are sexual offenders registered down the street from me that served less than 10 years and there was more than 2 years age difference. Try 10-20-30. That is total b.s. Pigs!

That's fucked up big time, it's consensual sex between teenagers, they should care for the real crimes instead of sending innocents to jail.

Here's the deal. At the time this happened ( a little over 2 years ago ) he was 17 and she was 15 and in the state of Georgia there was a law on the books that said if teenagers that are less than 2 years apart in age have sex it is a misdemeanor, however if they have oral sex it is a felony.

He was at a party where a girl had sex with another guy on camera while she was drunk and when she woke up she knew she was in trouble so she lied and told her family she was raped. The tape proved otherwise and those charges were dropped, however, they also had this kid on video getting the blowjob so there was no way for him to argue that it didn't happen. They decided to prosecute under this old law because they said that since she was 15 she was under the age of consent which is 16 in that state. they got the conviction. Little did anyone know this conviction came with a mandatory 10 year sentence. So he went off to jail.

After this all happened the state changed the law, but didn't make it retroactive so he was stuck in jail. Now that he is in the system, it's going to be very difficult to get the result thrown out. It looks like his best bet now is to try and make this a federal case and say that this law and case violates his basic civil rights so they can move up to a federal courts.

All in all it's a fucked up situation.

I also think a big part of it was he is black she is white and its the south.

No... just oral sex... and just in Alabama. Everything about this whole situation is stupid, but one of the stupidest parts is that he would be a free man right now if he just had good ol' fashion, regular sex. For some completely unknown reason, oral sex under this law is a felony, but when everyone's head is in the "appropriate" place.. its a misdemeanor.

Man that sucks for that kid, there is no way he should have to registered as a sexual offender. That wasn't a sexual offence. Granted they were both under age, there was no reason for jail time as well. Teens have sex. There are counseling programs out there for these types of things...

this was the cover story on espn.com not too long ago (and i think espn the magazine). all this press coverage will probably create enough incentive/motivation to let him go.

This is really fucked up.

There was a video tape and reported rape at the part. A girl went to the party and ended up drinking and having sex with a guy while it was video taped. The next morning she woke and realized that she was in trouble with her parents and told them she was raped. The police rounded up everyone she named as being at the party and one of them had a video of the whole thing that showed that she was lying about the rape. All the rape and rape related charges were dropped, but the tape showed this kid getting a blowjob too so the went after him and some of the other kids in the tape with this crazy law.

As a bright side to this all of the press coverage has helped. The reason the supreme court of Georgia wouldn't overturn his sentencing is because the law was changed the changes did not allow them to apply the new law retroactively. A state senator is working on a bill that will help to change the sentencing guidelines for people sentenced under that law before it was changed. In short, it will let the judge go back and re-sentence him without having to stick to the mandatory minimums. It looks like this senator is really focused on this, so hopefully he can get it passed and get this kid out of jail. here is the article about the the senators work
