true double opt-in lists are exempt from the Can Spam law.

This is what I was thinking too. Only for non solicited email
Thanks :)

double optin does not need to be CAN spam compliant as far as I know. As long as you have a valid remove link you're fine. (but I am in no means an expert)

Do you have a referring doc that specifies that?

baddog 05-10-2004 09:33 AM

What do you mean is it exempt? It still has to comply with all the rules set up, ie: a way to opt-out, a time/date/IP stamp of when they opted in, etc

If you have any questions about the letter of the law, I suggest you read http://www.spamlaws.com/federal/108s877.html or do a Google search, and educate yourself: http://www.google.com/search?hl=en&i...=Google+Search

You are correct.

The can spam rules do apply to double opt-in e-mails.

They do not however apply to the changes that take effect on May 19th.

it is my understanding from reading the d.o.c.u.m.e.n.a.t.i.o.n.at the link below that " Prior Affirmative Consent" negates the need for a "Requirement to place warning labels on commercial electronic mail that contains sexually oriented material"

http://www.ftc.gov/os/2004/04/040413...lfinalrule.pdf

page 43.

hope that clears things up.

the short version is here:

even more reason to make sure you have a time/date/IP stamp of when they opted in

EviLGuY 05-10-2004 05:35 PM

Whynot just comply with can-spam anyways? Its not like they are super rigorous rules to follow..

Swanks 05-11-2004 03:40 AM

IF they are true optin/double optin then you shouldnt have to worry about being compliant. But just to be on the safe side id comply incase you do have a few nasties hidden in the list.
