First Charges Under Child Registry Act

MICHIGAN -- Attorney General Mike Cox has filed criminal charges against California-based RR Media and a Florida company, Data Stream Group Inc., for sending e-mails promoting gambling and alcohol to addresses registered under Michigan's Child Protection Registry Act. Cox said the charges are the first of their kind in the country and may subject the e-mailers to a fine of up to $10,000 and other penalties. In addition to the criminal cases, Cox filed civil actions against the two companies in Ingham County Circuit Court. These companion cases to the criminal actions seek injunctions against further violations and other statutory penalties.
Utah has a similar Child Protection Registry law. FSC filed suit in November, 2005, in federal district court in Salt Lake City, challenging the constitutionality and legality of that state?s anti-spam ?child protection registry? law, which went into effect July 15, 2005. First Amendment attorney Brad Shafer is local council in Michigan as part of the FSC legal team overseeing the Child Protection Registry Act challenge.

oops, People forget that the number of "charges" and their affect in prosecuting can be staggering when emails are involved.


(example, "defendant is charged with 62,000 counts of armed robbery")

A "child" shouldn't have their own e-mail address in the first place. Unless its on a private network, within a school system.

With the way all of these ridiculous laws are being whipped out lately, the children will be running the country before long...

Then again, they'd probably do a better job than is being done now..

thats right, leave e-mail marketing to time warner, metlife etc.

which was the entire basis of the can-spam act

this isn't an attack on adult, its an attack on freelance e-mail marketers
