They do it all the time, I really wish AFF would do something to curb this

We send them Notice of copyright infringement at least once a week and sometimes two and three times a week it seems like !

and we are not the only ones, I see some of the others too, as we use the same firm to notify them with as a few other big photogs in the industry do.

I sent the affiliate an e-mail giving him 2 days to take it and any other stolen content on his sites down or send my copies of the licenses. If he fails to comply I will ban his account at that time.

Its nice to see AFF working with him to get the content down, rather than just terminating him outright. Everybody does stupid things, and this is one of them. I've never thought of companies that make knee-jerk reactions to mistakes. Besides, if he's terminated immediately, he'll probably just move to another sponsor, and that doesn't help get the content down.


Working with people is the best way to resolve problems in this industry, and I respect AFF for taking a realistic approach to this.

I also like to give accused affiliates a chance to produce a license. If I just outright ban accounts everytime I get an accusation I would end up screwing over legitimate affiliates. If this particular affiliate doesn't remove the content or give me a copy of his license then he will have his account banned on Tuesday morning which is the end of a payperiod so he will not get paid for more than just 2 days worth of traffic.

I see this morning that he's pulled the content from that ONE gallery only. I assume he hasn't produced licenses for all the rest?

If you want you can make galleries that promote them but also include our banners on the page. But you must still make them the main focus for using the content.

This guy has been doing galleries like that for almost 3 years according to my database, on more domains than just that. You can't tell me he doesn't know it's wrong, he's not a newbie.

The thing is.. It's Danni.com... For years, Danni had it in their TOS/Faq that you couldn't use their content.. yet all their affiliates did and they turned the other eye because it made them a lot of cash.. In fact, several of us asked for content honestly so we could compete and were refused. I even bitched to them once (that person is no longer the affiliate manager) and was told that their top affiliate had made almost $1M with them. Yeah.. while breaking the rules in the process... So I frankly couldn't give a shit.. They refused to hand out content to honest webmasters when asked yet let WMs rip them off and promote them with the content for years while turning a blind eye.

Excuse the language, but that's bull shit. You can see from your own affiliate records how long this guy has been doing this. He no newbie, he knows better and is just playing you for a sap.

If you were serious about dealing with content theft there is enough proof in my first post to nail this guy to the wall. It's quite obvious you'd rather turn a blind eye and continue to make money from the illegal actions of guys like this.

My TGP's will no longer be accepting galleries promoting AFF.

That may be true, but that's all water under the bridge and Danni.com is just the tip of the iceberg here. This guy does the same with content from dozens of sponsors, promoting AFF, pills, etc. all of which have one thing in common, they have really poor or non-existent promo content.

If you want you can make galleries that promote them but also include our banners on the page. But you must still make them the main focus for using the content.
Uhhh... it's not up to you to give him permission to do that. If I ran a program with exclusive content and allowed my webmasters to use it, I sure as hell wouldn't let them promote other programs with it, no matter what the "main focus for using the content" was. And I have no doubt that many program owners would agree.

I know that AFF banned him. But I am wondering, if he is using your content to promote some one elses site, why you wouldn't send the webmaster an email, if that didn't work or you didnt want to spend time talking to him

Write the owner of the site with a copyright infringement and send a cease and desist letter.

Or email his hosting company. Look for the hosting company's TOS which usually has strict rules about copyright infringement and quote those rules that apply them to your situation.

I mean if it was me I would be doing things like that over contacting AFF about it on a board and getting him banned. They can't pull the guys content off his server. Or have him shut down from his server.

Maybe I missed it and he did or he is and just didnt say it I don't know.

No offence at all, don't want it to sound like I am trying to be a dick. Just thought I would say my two cents. I know it's not your content but a friends, but still. I would want AFF to ban him also, but I would do other things before contacting AFF on or off the board if it bothered me that much.

Yeah.. So he probably used content from other sponsors to promote Dani at one point as well since they had non-existent content. What goes around comes around.

It's not right, but the truth is, it happens ALL the time and sometimes the program that gets screwed for awhile, benifits later. Frankly I think that if the sponsors really gave a shit about it, they would be actively going after that sort of thing. The fact that they don't should tell you a lot. The only time they deal with it is if it's pointed out to them or if they stumble accross it.

That's bullshit... It's standard practice to promote one program/site primarily and then add a banner or link at the bottom or something different.. For YEARS free hosts were the norm with all their banners and links for other products and not one sponsor I've ever seen complained about it.
