I want to move out of my apartment. My car has been broken into, and backed into (hit and run). Police reports were filled but nothing came of them. The tenants above are loud, and thier ciggarette smoke comes down into my apartment. Ive been falsley given a eviction notice. (It specified that I didnt not pay rent.) But I did. And that was fixed.

My questions is. Would I have a case, if my landloards decided to fight for me to not finish the lease. I want to move out now, and im 3 months into a 12 month lease. The ciggarette smoke alone should let me out.

Discuss, please. I need opinions.

I would send him a written notice that unless certain things are resolved (loud tentants, smoke,whatever) you will be forced to move out.
