It also seems pretty clear that while he aided and abetted the 9/11 miscreants he didn't actually know what they were planning, so worst case scenario for him is that he gets done on the 'belonging to a terrorist organization' charge, for which the max penalty is ~ 10 years.

you are missing some facts.

one terrorist has already been rleased because the US has some terrorists wer are not allowing to testify.
