Are affiliates liable for sponsors content if its obscene?
If you promote a sponsor and use their content, are you liable for obscenity charges (such as distribution of obscene materials) if the sponsor's material is found obscene OR is the change they will go after the sponsor first? I'm asking because there are several high-profile obscenity charges against sponsors that are still operating and affiliates are still using their content...

Very good question... is it production of the material or making it available on your server that is the issue?
probably both for different reasons. Like producing coke or distributing it. |
