The majority of "offshores" do not recognize US Patents.. - (ie they are US Patents) - they mean nothing in other areas and I doubt even Acacia is so dumb they want to spend money in all offshore jurisdictions - that is assuming any court will listen to their claims.

If they do....and succeed... roll on another 10 years before the case is heard

from what I understood from the show, affiliates are only safe if the sponsor they're promoting is licensed with Acacia. If the sponsor isn't licensed with them then they expect to collect from the affiliate.

Sort of like if a plane crashes and the airlines won't pay, then sue the makers of the bolts.

As long as you hold a visa-citizenship from a country that recognizes the patent, you WILL obey that law or be fined-jailed. There are alot of other ways they will get to you no matter where you are.

absolutely but then again, that is what a good lawyer does. he/she will dance around an answer until someone less knowledgable gives up and thinks the answers presented before them are etched in stone.

this was informative. i do believe impa has information that will change the playing field a bit. lets be honest here, you wouldn't take on a company with patents of this magnitude without having information that will either end the game or make it run into some serious overtime.


this reminds me of a really good baseball game. with that being said, go yankees...lol

It was a stupid idea to give the enemies of the adult industry one of your own propaganda tools.

I can't wait until D-Money has NAMBLA on his show to tell you why ASACP is wrong about child porn. He has said that people have a right to both sides, right?

It was a stupid move and it will hurt the adult sites in the lawsuits and help Acacia.

Bhuto, OZ signs a lot of the international treaties. ANd I for one couldn't-wouldn't want to try and keep track of those things. Do you think that they couldn't pull one of those in to use as a side note? If you do, then you are more trusting than I am anymore.

Big difference, Acacia actually has a legal patent and can ask you to pay them according to the law.

They're not wrong unless a court invalidates their claims.

But I do get your point.

I'm not going to go into my situation, but it's more complicated than that. However I am aware some of the treaty situations and am waiting for the results of the free trade agreement with the US to be worked out in particular relation to this issue even thought it may not be applied to me.

Anyway, I did this show today because I felt as adult webmasters we have a right to know Acacia's claims.

You're all entitled to your opinions, I don't think any less of anyone if they didn't like it. You don't have to like it, but you shold be informed....

What a horrible comparison. Are you serious? You are taking one thing that is not only illegal but not endorsed or accepted by anyone with morals and values, and you are comparing it to a company that by law has the right to protect their patent. They are doing nothing illegally, and they have some people that have accepted it.

I'm not saying its right, but if you are going to make a comparison, then at least make a more educated one. I have gotten my paperwork, and I've read it, and sent it to my attorney, and they have a valid claim, it sucks, but still valid. And until someone proves their patent to be invalid, well, your only real choices are to settle with them, or possibly go to court, or operate your business in a country where they don't have the patents.

Let's see what IMPA has to say next week on the radio show. I'm very interested in hearing their opinions on todays show.

D-Money for President. You were great today. You handled yourself very well, and asked great questions. I learned a lot of new things today, and in my opinion, these new learnings will help me more than scare me.
