Interesting - he keeps referring to a percentage of gross - our package made NO mention of a percentage - for us there was just a flat fee.

Couple things to think about
Having Berman on today let you know more about who/what you're dealing with with regards to Acacia's position Having listened to part of the broadcast and then going back and listening to it in entirety I realized Acacia may still "double dip" (listen closely, video providers are only exempt and covered by what Acacia terms webmaster license if the video providers DON'T provide video samples on their site and don't make content available via zip file download) In my not so humble opinion Berman didn't come off well in some segments of the show and obviously did a lot of tap dancing Darren you did a very good job today, much thanks it's better to be educated than not |

No worries, it can be debated. Me personally, I'd rather know as much as I can before heading to the show and meeting with them. This gave everyone an idea of what their claiming. I'd bet everyone listening learned something they didn't know, even if they won't admit it. |
I still think the main way to prove that the Acacia patent is bullshit is to go back to the original reason that it was rejected the first time it was put to the US patent office. They found it to be "unpatentable." When the Acacia guy was grilled on it he didn't have much to say, only that the first time they didn't "understand" the technology.
It's obvious to me they just pushed their bullshit through the overworked U.S. patent office until someone bit on it. Interesting Reading on the Acacia Patent (.pdf) |

All I have to say is, others should be in my shoes for a second and try asking the questions. The pressure of asking the right questions is tough enough. I've been up for 48 hours making sure I asked the best questions I could, worded the best way. When you listen to the archive, listen to the way things are worded. It took time to ensure I wouldn't be clowned for asking the wrong questions. And if I get slammed for my questions, I know I can handle the heat. I've taken heat in the past. But I feel this was the right thing to do, communicate effectively. I'm an adult webmaster like everyone else, so I know people wanted those questions asked... |

from what I understood from the show, affiliates are only safe if the sponsor they're promoting is licensed with Acacia. If the sponsor isn't licensed with them then they expect to collect from the affiliate.
Sort of like if a plane crashes and the airlines won't pay, then sue the makers of the bolts. ------------------- I was ashamed of some of the foulmouths that thought they were impressing SOMEone, whoever they were. IDIOTS. But then what does a kid or someone with the IQ of a rhino know about business relations or respect. (I may not agree with them and might cuss them in a private meeting or in my own office, but in public, NEVER) ------------------- Prior Art in and of itself will not overturn the patents. It needs to a specific SET of processes USING the prior art to win. Get it thru your single-celled brains. ------------------- Their patents only cover so many countries. As long as you hold a visa-citizenship from a country that recognizes the patent, you WILL obey that law or be fined-jailed. There are alot of other ways they will get to you no matter where you are. ------------------- Did ANYone really expect this guy to be upfront and truthful?? If you did, then go to HomeDepot and apply now. We're a-hirin! Pay starts more than burger joints and insurance, profit sharing etc!! lmao The man (choke) is an attorney first and a CEO second. Yep, expect anything truthful from him with out their own spin. ------------------ D$, you really should have thought about the traffic that would pop up. Whatever were you thinking of?? ----------------- Lady M, trust that acacia will try to attach the income generated from any Canadian site that does business with the US based companies. They could hold that income up for a lonnnng period of time GF. So in the words of one of the gfy people who is so famed to be thick in the head, the show was more fluff and fodder than anything else. |

this was informative. i do believe impa has information that will change the playing field a bit. lets be honest here, you wouldn't take on a company with patents of this magnitude without having information that will either end the game or make it run into some serious overtime. this reminds me of a really good baseball game. with that being said, go yankees...lol :thumbsup |
It was a stupid idea to give the enemies of the adult industry one of your own propaganda tools.
I can't wait until D-Money has NAMBLA on his show to tell you why ASACP is wrong about child porn. He has said that people have a right to both sides, right? It was a stupid move and it will hurt the adult sites in the lawsuits and help Acacia. |
Bhuto, OZ signs a lot of the international treaties. ANd I for one couldn't-wouldn't want to try and keep track of those things. Do you think that they couldn't pull one of those in to use as a side note? If you do, then you are more trusting than I am anymore.

They're not wrong unless a court invalidates their claims. But I do get your point. |

It's your show and your right to do what you did, I just don't think it was the right decision. I am happy to see you're having IMPA on again. |

I'm not saying its right, but if you are going to make a comparison, then at least make a more educated one. I have gotten my paperwork, and I've read it, and sent it to my attorney, and they have a valid claim, it sucks, but still valid. And until someone proves their patent to be invalid, well, your only real choices are to settle with them, or possibly go to court, or operate your business in a country where they don't have the patents. Let's see what IMPA has to say next week on the radio show. I'm very interested in hearing their opinions on todays show. D-Money for President. You were great today. You handled yourself very well, and asked great questions. I learned a lot of new things today, and in my opinion, these new learnings will help me more than scare me. |
One correction. I didn't mean to say a valid claim because in my opinion, I believe it will be proven to be invalid in the court process. I meant a valid patent.
My bad. |
