What i don't understand is why arnt these other BIG companies contributing to our fight? Are they even aware of what is going on in the adult industry with these guys?

Im thinking if they win against us it will set some sort of precedent which they all will have to pay...so wouldn't it be wise for some of the big guys to help?

"Their Lawyers" probably don't specialize in Intellectual Property & they would most likely seek outside legal counsel from a firm that does.

The IMPA has what is probably one of the nations bests IP firms (if not THE best? - Fish & Richardson.).

I'm betting they aren't cheap.

You should probably donate to the IMPA

also, I was reading in time magazine, about natives suing the canadien goverment for abuse,

and the governmetn draged the churches into the lawsuits to limit there liability,

the adult industry should be able to drag in other companys and force them to other side,

the legal system should allow for that,

its not fair,

that if you have 2 stores side by side breaking the same law, and you sue the one most likely to give up,

not fair play at all,

anyone know if this posible or know a incedent of this happening

It would be interesting if someone took list of possible patent infringers and let them (their staff writers, their legal departments, and anyone else who might give a shit) know about what is going on with this case.



Most public companies can be addressed as:

ATTN: LEGAL DEPARTMENT

And if the letter is registered, it'll get all that much more attention.


The outcome of the battle over the validity of the patents between the IMPA and Acacia may to be very pivotal for these other companies if they decide that they want to challenge them as well on a later date.

It's my opinion that they should be informed of what's going on.

The more precedents they can set while going after the smaller guys then the more ammunition they will have if they decide to tackle the big names.

Adult is a VERY easy target. I think they are a bunch of c*nts but their strategy is a good one...

And that's another thing I was wondering. Hosting is the process for streaming. If they go after the process, you cut off the head with the host. Make the host pay, then they pass that service to their clients as a benefit of hosting the process with them.

They should most definitely be informed.. To be honest, I do and always have felt the issue should be taken to any and all mainstream media outlets that will pay attention to it. Why? Not just because it's preserving our business, but the implications of how this is going to affect the rest of the world (especially the internet and media world) at large are profound.

It IS a good strategy.. I mean who's going to stand up for PORN!? However, I do NOT think they expected the amount of resistance and co-operation that they have encountered in the adult community, and I definitely think it has them running scared.. Us "pornies" are supposed to make enough money to just pay them and be done with it.. I guess they didn't realize that us "pornies" are generally good business people who recognize extortion when we see it.. Otherwise we wouldn't survive long in the industry.

Anyway as far as mailing the companies? The IMPA could do it, I'm sure that would be perfectly legal to inform them, since it is in there best interest to follow along and have interest in the case.

And if individual webmasters did it...

I don't see why it would matter if you ran AnniesAnalPalace.com or if you signed it as Annie Smith, Concerned Webmaster.

Either their (legal department) will have interest, or they will not.

Absolutely correct.. They will likely want to know if they may end up in court within a year or so owing large amounts of money.. Generally that makes anyone willing to listen, no matter what the source is. It's simply the truth, and they can check for themselves.

Anyway as far as mailing the companies? The IMPA could do it, I'm sure that would be perfectly legal to inform them, since it is in there best interest to follow along and have interest in the case.

And if individual webmasters did it...

I don't see why it would matter if you ran AnniesAnalPalace.com or if you signed it as Annie Smith, Concerned Webmaster.

Either their (legal department) will have interest, or they will not.

If the IMPA does it, is that considered to be creating a conspiracy?

Actually their patents aren't restricted to the internet in any way, shape, or form. It's simply one of the forms of media that's taking "advantage' of their "patented technology". The first to be hit were video on demand companies that supplied movies to hotels...
