Is being in the EU good for the porn business?

I would be interested to know your views.

My understanding is that the UK ONLY legalised porn because under EU law, if a business trades in one EU country, it must in all (or somthing like that). Thus it was ONLY the year 2000 porn was legalised in the UK.

I do fear if the UK comes out of the EU it could simply ban porn.

After the 2012 ish campaign by the UK governments ATVOD Agency essentially making it impossible for any UK porn company to exist in the UK, most companies either closed or moved into mainland Europe.

The few that did stay in the UK partnered with companies mostly in the United States and used them to run the parts of their company that the UK government deemed "bad". For instance, carried on producing & moved their web operations offshore. Affiliates were fucked full-stop... Leave the country or close shop. Same for cam models....

I think it was last year that new laws made it even worse, essentially banning the filming of a long list of sexual acts in pornography. Again, more companies left.

I am not sure there are many UK porn companies left at all. I can think of only a handful.

Most moved to Prague/Barcelona ect....

As for porn in the rest of Europe, or at least when it comes to the EU member states I don't see anything happening as extreme as the UK. Porn companies are safe to operate within the reasonable and non-totalitarian laws unlike what companies are experiencing in the United Kingdom.

If the UK does leave the EU, I do think we will see some very extreme censorship happening in that country.

I personally think the USA is still the best place in the world to operate an adult company. The constitution sure is a blessing!

If you are a UK resident and have an adult website, legislation states that no nudity (cock/tits/vag) can be seen before a customer verifies their age *enters their credit card details*.

So you can have your blog, you just have to cover up anything that constitutes nudity.

If your business is registered in France, it makes no difference. If you "operate" in the UK, you are liable.

Do they have porn police? Ask some of the companies ATVOD fucked over Ofcom now regulates On Demand services | Ofcom (they have now been merged with Ofcom)
They will drag you into court like a dirty criminal, tell you that your endangering minors and hit you with huge fines (Playboy got fined a LOT of money)
+ shoot your name all over the mainstream press.
Might not be porn "police" but certainly not far off...

On the flip side, you can have a UK company that sells porn. You just can't reside or operate inside the United Kingdom.

Essentially, look at it this way.

If you run a tube site in the UK... Before a surfer can see any video, thumbnail or anything, they have to give you their credit card information to verify their age (despite the fact a large percentage of adults in the UK don't own a credit card).

It's never going to happen. That is why right now the UK government are trying to bring in new legislation that states, if sites like PornHub "Don't do what the UK says" .. they will block these sites for the whole nation..

They can ban UK companies publishing it. And that's it. When they have no UK company producing and 10 million consuming it from abroad. Maybe the public will wake up.

The UK needs to stay in the EU to stop the UK govt running wild with censorship and banning this, that and the other under the guise of protecting children and terrorism.
For all its faults, being in the EU provides a little more of a level playing field and helps reign in the UK govt - just a little.

The EU issued a directive to stop children viewing porn and to regulate the Internet. I think it was the one ATVOD worked under. Assuming the EU won't try to censor and ban things is foolish and on situations like porn, it's down to the country to set its own rules.

Who reigns in the EU Government and bureaucrats?

Until 2000 it was banned.

Even when they allowed it, they have (and still do) have it only allowed at the min level to be in line with EU law.

For instance to buy a porn dvd you must go onto a licensed sex shop. You cannot have a porn dvd posted to you unless its from outside the UK into the UK.

In the UK we are also one of the very few countries that censor all films. For this privilege you have to pay many thousands of pounds for the film sensors to see your film (regardless if its porn or not) before you can sell it on dvd or show it at the cinema in the UK.

For shooting yes u can find many countries where u can shoot. The best is Eastern Europe. For a company to start, try Cyprus.

But in general, the EU sucks because the only thing that knows is to put rules and laws all the time. That's why will be back from USA and China in everything.

But do a search from country to country because yes, the EU has laws and rules but every country has their and some are more elastic to them.
