I'm sure he is very well aware of what a lot of people use the software for as in RIPPING ENTIRE BLOGS and cloaking.

But you are right can't blame the guy who wrote it. He is just trying to make his $ not his problem what webmasters do with it.. Bottom line is money who cares right?
