Didn't the host comply with your request? Did the spammer keep spamming after your notification of the host?
There are some state statutes banning spam. You can sue under those statutes and try to recover attorneys fees. This should be a good deterrent since attorneys fees are NOT cheap. The damage to be proven is different under these statutes.... they basically work to enable private parties such as yourself to use the courts to enforce public policy against spamming. Your reward is the attorneys fees.
