Actually they're not deported and that's the problem.
When an illegal gets arrested for something, because of the laws we have now, they most be treated the same way as anyone else. That means charged with a crime, booked, and a bail set.
Local and state officials have to call fedral immigration officials to come and pick up the illegals.... but they very rarely show up when called. Or they show up way to late they the illegal is already bailed out of jail, and got himself a new id and alias to go by. Local officials have no authority to detain an illegals longer then necessary, if bail is posted they have to release them.
In my younger days I worked construction and have spent a few nights in jail for petty stuff. Trust me when I say I've seen it all first hand.
