What kind of person lives in a "nice" gated community with a "nice" house and "nice" cars yet needs to borrow $400? I don't mean to sound like a prick, but really, $400 is peanuts. Its nothing. If somebody owns all of the above and needs to borrow $400 from somebody they don't really know, they need to get their priorities in check. Bank holding a check? Yeh, RIGHT.
chase I know you already realize your mistake and I don't want to kick you while you're down, but you really need to think about stuff like this before "helping" somebody out. Don't let others take advantage of you. As already mentioned in this thread, NEVER lend money you aren't willing to lose. And certainly don't lend money to a non-loved one without getting a return on it.
You know where he lives. You have enough information to take action. Call the police, ask their advice. People place liens on properties for situations like this, and from what I understand they really aren't that hard to get instituted, but obviously I'm no lawyer or expert. Get your money back.
