First of all, the conspiracy theories tend to revolve around the belief that he knew about it, had a hand in it or some other variation... not that he ordered it himself. He's way to dumb to order anything himself, much less come up with some organized attack.
Secondly, in case you haven't noticed, Bush doesn't really seem to have much regard for the Constitution, much less it lets him or doesn't let him do.
