I don't see how they can't win. The site was selling access to a video they don't own or have rights to resell.
Proving damages is something else, however. They needs facts and figures of how many downloads were done so they can sue for X per download. Last big suit won was $1,500 per image being used without permission, wonder how much they can get per video download.
They should also go after every scummy webmaster who promoted this video for contributory copyright infringement.
Still don't see how they can claim to have just 2 million images and videos and yet claim they add 350,000 per day.
