The difference being the Airline could argue that the T-Shirt was offensive enough to cause a safety concern in the air.
Again....public accomodations do not protect discrimination based on clothing.
It's the same reason that 80% of nightclubs DO NOT accept people wearing Sneakers. You have no case.
