I think that the google / perfect10 ruling, combined with what was almost certainly a huge pile of remove requests, C&Ds, and DMCA complaints has lead them to pull the system down and re-examine the situation.
While pure usenet resellers (they give you a username and password, and you use your offline newsreader to download the threads you like) have the ISP immunity thing going on, once you filter, editorialize, sort, extract, and re-format / re-endcode images and videos for your end users, you are no longer safe. That lesbodojo was here taking remove requests yesterday shows that they understand that some (most if not all) of the content on their servers cannot legally be used.
I personally hope they stay down for a long time to come.
