For networks like Kazaa, edonkey, Gnutella, etc. that's true, but they still face the problem of cooperating internationally. For anonymous p2p networks like share, winny, freenet etc. (which send data through other users, so it isn't clear what the originator is) it's a lot harder.
Still, they could be doing loads more than they're doing now.
