Irrational laws get their just(ice) desserts at trial, from rational benches. In other words, let 'em make whatever laws they please. If they're unconstitututional or just plain stupid, The People will have their chance to say so after a good amount of Their money has been wasted on wasteful bureacracies and litigation. Why do they do it, you might ask? Because some people abide the law, just because it is the law -- thus achieving the aims of behavior curtailment desried by those who proposed, enacted and gave their names to these laws. Consider, also, the censorial effects of the CBS/Viacom fine, after Nipplegate.
