Actually, if it's a cash and stock deal, the actual amount of the deal is not set in stone, until the last dollar is squeezed out of the stock. It would be entirely possible for the stock to be worth nothing in the end... so the only real value to the deal would be the cash.
And of course, unless someone's willing to post a certified copy of the entire terms, just quoting "sources" doesn't make XBiz wrong... or Alien right.
Then wasn't there also mention of a pesky little performance clause?
I seem to recall seeing that in there somewhere... and if that's indeed the case, and the performance isn't what the buyers are expecting... well then, there might not be so much cash at the end of the day either.
