Is it really extortion or blackmail? Not to dive into semantics, but it seems to me you are basically letting him make restitution, which he would probably have to do if he got convicted. by the set up you have you are:
1. saving the court system time and money
2. saving yourself and this guy some time and attorney fees
3. possibly keeping the FBI out of things (I'm assuming this would be considered interstate crime, but im not an attorney).
4. letting this guy keep a conviction off his record
5. giving yourself a better chance of actually recieving restitution
seems pretty good to me
