Do you have a extra $250k or more that you don't mind pissing away? Cases like this cost a hell of a lot of money. In a case like this, you have to spend all that money just to prove you are innocent and the best part is... Even if you win, you don't get shit back..
Freedom of speech and Justice for all is only for the rich in America. If you don't have big bucks like I'm betting he doesn't, it's un likely you could stand up and fight a case like this with out financially ruining yourself for a very long time.
That being said, there are other ways to fight this kind of thing, and I for one would have never agreed to give up the domain name.
