Joe, (amacontent) what do I have to do to get my money?
Joe, I hate to take this public but I feel like this is just one of two options I have left to try to get my money back.
I prepaid for 10 custom videos in March 05. Each video was $250, total I sent to you was $2,500. I specifically remember telling you that I wanted to pay for 5 at a time and just wanted to send you half at first. You told me that I had nothing to worry about, that you have never screwed anyone before and you had a good rep, and you insisted that I send the money for all 10, which I did. I had also purchased 5K worth of content a couple months before this and did not have any problems so I took your word for it.
About a month or so later I received 3 videos, you told me you would finish the rest asap. From this point on correspondence with you was very poor. Since I was working on other projects, and had purchased content from you in the past, I told you (after 3 months of waiting) that I would just take the balance and apply it towards future content purchases for my other projects I had in the works. After the hurricane, all of my work got backed up bad, and those projects were put on hold indefinitely. At this point I started trying to contact you again. I explained to you my situation and that I would like a refund for the balance (7 videos @250 = $1750 I was owed). You didn't reply.
It was about one month ago you contacted me and said that you had 5 videos completed and you forgot to send them to me. Even though I was asking for a refund at this point, it was nice to know that you had finally completed some of the work, and I was willing to accept it instead of the refund. I was a little upset though, because part of the deal was that I was suppose to approve each model for the shoot so I was a little anxious to see what the girls looked like that were used. I specifically said all along that I needed different types of models (niches) for each shoot. Unfortunately for me, you didn't have any of their pictures online. So.... you said you were sending the videos and I would have to wait to receive them to see if they were something I could even use.
About a week ago I finally got you to reply and asked you where the videos were ? I didn't receive anything in the mail. You told me that you had the tracking number for the package. After a couple days of asking you for the tracking number you told me that your secretary had lost it. I then asked you to resend them and after a few more days you told me you weren't sure if you had copies.
Let's see, I wait months for work I prepaid for, I then accept the fact you are either too busy or can't do the rest of the work for me so I suggest I convert the amount I paid towards content from your store (I had a feeling a refund would be hard to get, lol). When I later notify you that I will not be buying content from you, then 5 videos magically appear. And then they magically disappear. No tracking number, no copies, no nothing.
I told you last Wednesday you had till the end of the day Thursday to either find the videos (that I doubt were ever made in the first place) and send them and the balance $500 by the end of the day. If you could not find the videos then I expected payment by the end of the day for the $1750 owed to me. I gave you paypal and epassport options, or send check. Either way you had to send something by the end of the day and I wanted the tracking number for proof if you were sending through the mail. Thursday came and went with no reply, Friday, Saturday and Sunday for that matter too.
I want my fucking money. Why does it have to be so hard to refund someone. You didn't do the work, so you can't keep the money. IF you did do the work and you lost it, that makes no difference to me, I didn't get what I paid for. I was VERY patient with you. It just pisses me off that people do business this way, and all along you keep telling me how you never screwed anyone before. (when i was even lucky enough to get a reply from you.) You were suppose to have all 10 done in like 3 weeks time, it's been over 9 months and you are still screwing me around. I would refund someone right away if I couldn't do the work they paid for, but that is just me. Action is worth a thousand words.
I hope by posting this you will send the money, apologize and make up a few excuses about what happened and we can all move on. If you still keep screwing me around I will pass this to my attorney to contact you. Between Ibill, and 3 -4 other situations like this (where I paid someone for something and they did nothing and tried to avoid me and keep the money) I am keeping my attorney busy never the less. Nothing pisses me off more then when you pay for something and the other party not only doesn't follow through but they try to keep your money.
