When taking pictures in a public or private venue (ie. webmaster show, concert, fashion show, club). What constitutes as consent to take and use the picture. Can the person posing a smile at the camera be good enough to be considered consent? Is there a difference if your making profit off the photos? (ads, or membership)

I know the first response would be to talk to a lawyer but I already know what he will say. Would love to hear some input/experience from you guys.
