What SI told that all the mailing lists were double opts? 350 spam complaints in 2 hours would translate to about 100k pissed off people (the actual number of people who will correctly get a spam complaint to the right host account is actually fairly small... I am guessing about 1/10 of 1%). Most of the people probably just filtered it off or hit delete, and it ended there.
350 spam complaints in 2 hours is a pretty impressive number.
If SI suffered losses as a result of the actions of the client, losses that could not be forseen, or if they were in a position where the boxes were used in a way that would be unacceptable or outside whatever agreement was made, then it is up to the client to cover those costs, IMHO.
HOWEVER: If SI was aware of the client's intention (however reprehensible those intentions are), then SI needs to eat it at both ends.
At the end of the day, these sort of things only serve to remind me that most of the people making money in online porn are scammer, spammers, and jammers.
