At moderated boards, such as GFY, the board is liable for any defamatory posts/threads, and more. I know this firsthand, a board I moderate at was served papers because of posts and threads about a large domain registrar, the message boards lawyer suggested that we comply because the opposing party had grounds to sue and could have easily shut down the company. We had to delete and move every post and thread regarding this particular registrar.

So yes, moderated message boards can be held liable for illegal activities on them. Boards that are not moderated do not carry the same risk, which is why chat rooms and AOL don't have problems in this area.
