umm i didnt see any speed limit posted.. he couldn't have "clearly" been going over the speed limit if we dont even know what it was..

Barring any unseen things, this is totally the cars fault.. you can tell there was no other traffic in the bike's lane so there was nothing to interfere with her/his view ( the cars view )

The person just pulled across, then looked , tried to stop , but it was to late they already had their bumper out.
