if the person is aware of the std its a 3rd degree crime i believe for her to engage in any kind of sex. IF she tells the producer, and the producer says its not a problem, that is a major lawsuit waiting to happen.
Most release forms cover the producer in case that happens but the producer has to show he did his due diligence on the performers such as an aim test, or denail of plausibility, i.e., dont ask dont tell. In which case, in a cour of law, it would most likley be pinned on the performer.
Its a fucked up situation for sure,
