Sorry to hear about this problem. This is definitely a weakness in the functionality of the internet from a webmaster point of view. I have been through this a handful of times, twice where it greatly affected our business for 2-3 months. It's a pain in the ass and very difficult to find a solution.
In June a guy that I used to work with tried to extort a domain name from us. He went on a rampage spamming about 10 of our adult & non adult domains. Needless to say our whois email address was totally fucked with "non deliverable" spams and tons and tons of complaints. Our voicemail box got flooded, fax line and office phone as well. It was a mess. On top of this the income we were losing due to wasting our time with this is immeasureable (sp?). All of my and my wife's personal (address) info was included in these spams. I had to deal with all major ISPs on a daily basis.
Anyways we were unable to find any type of legal solution. It is very difficult to deal with ISPs and hosts in a situation like this. I was very lucky that at least my hosts worked with us and did not take us down. Anyways as a last resort I am sorry to say that the situation was handled physically the "old fashioned way" with baseball bats. Every other possible resolution was tried but nothing worked and it became a matter of livelyhood. Though we had one voicemail threat our lawyer said it wasn't enough to make a case and tracing these spam fuckers is near impossible these days.
While I would never condone this as a first resort the frustration level becomes very high as no one has figured out a good way to deal with this kind of situation yet. And I found that no one was really very helpful. You are basically "guilty until proven innocent". I wish you the best in finding the culprit and hope you are able to prosecute this individual.
