There is one problem with your logic: No filibuster will be needed, because it is likely that the republicans in the senate will ALSO vote against her.
THe current "don't comment on things you might pass judgement on later" logic means that you would have someone with no past record, nothing to show how they generally operate as a judge, and someone who (horrors!) might have donated money to both a anti-abortion group AND the democratic party in the past.
She isn't conservative enough for the republicans, and not liberal enough for the democrats. She will get the down on the "up and down" vote, and Rove will be a big loser (if this was his plan).
Meirs is toast - just a question of when.
