Shaky ground? I think so.
Broken and falling in? I don't think so.
It's a grey area in the law. You can threaten, but until you do something there's nothing the cops can do. IF he gets hurt, THEN your ass is in a sling, wether you did anything or not.
Best bet, don't do shit for quite some time, like a year, then hire someone to kneecap him. Your hands are clean.
FYI, if it were my wife, I wouldn't have given him warning. Just take him down and that's it.
