"If Avila is charged with murder under special circumstances and convicted at a jury trial, he could become eligible for the death penalty under California law. Authorities have not publicly addressed that possibility"
"According to court records, Avila was charged in 2000 with one count of a lewd act on a child under the age of 14, two counts of lewd acts on a child under the age of 14 using force, violence or duress and one count of criminal threats.
He was acquitted after a weeklong trial that stemmed from the alleged molestation of the two 10-year-old girls, the daughter and niece of his then-girlfriend. The daughter, identified in court papers only as Catherine, reportedly lived for a time in the same apartment complex as Samantha."
