well.. if you're going to be punished for a crime according to a country's laws then to be compensated as a victim of crime according to that country's laws is only even-handed even if it seems ridiculous.
(yes even though border jumping is in itself illegal.. like being hit and runover whilst carrying an illegally concealed firearm or pot or something would still leave the driver open to compensation.)
